Terms of Sale

These Terms of Sale (hereinafter "ToSale") govern the subscription to and performance of the paid subscription to the Viewroom service, published by Florian Pierre Bernard Zumbrunn, sole proprietor (see Legal Notice).
They complement the Terms of Service (ToS) and the Privacy Policy. In the event of conflict, the ToSale prevail strictly with regard to the commercial relationship.
Acceptance of these ToSale is materialized by subscribing to a plan.
1. Purpose
The ToSale set out the financial and contractual terms of the Viewroom Pro subscription:
- pricing and payment terms;
- duration and renewal;
- right of withdrawal;
- termination;
- warranties and liabilities.
2. Service description
Viewroom offers two plans:
2.1 Free trial — 14 days
Full access to the Service for 14 days, with no credit card and no commitment. At the end of the trial:
- either the User subscribes to a Pro plan (normal continuation of the Service);
- or access to the Service is suspended. Data and works are retained so that the User may resubscribe at a later date, under the conditions set out in the Privacy Policy.
No charge is made at the end of the trial — subscribing to Pro is an active step taken by the User.
2.2 Pro subscription
Full access to the Service, with no time limit as long as the subscription is active. Features detailed on the Pricing page at viewroom.art.
3. Price
The current prices are publicly displayed at viewroom.art/tarifs. As of the date of these terms:
- Pro monthly: €9.90 incl. VAT / month
- Pro yearly: €99 incl. VAT / year (i.e. €8.25 incl. VAT / month)
(where applicable) Founder offer: €69 incl. VAT / year instead of €99, limited to the first 60 spots. This rate is locked for life as long as the subscription remains active and uninterrupted. Cancelling and resubscribing does not allow this rate to be recovered.
Prices are displayed in euros, all taxes included (VAT inclusive). The applicable VAT under the User's jurisdiction is calculated and collected by Lemon Squeezy (Merchant of Record) and included in the displayed price: the User never pays more than the amount shown at the time of subscription, whether or not they are VAT-registered in their country.
The Publisher reserves the right to modify its prices. Any modification is notified to active Users at least 60 days before the effective date and applies only at the next renewal of their subscription. The User may terminate at no cost in the event of disagreement.
4. Term and renewal
4.1 Monthly subscription
The subscription is concluded for a one-month term, tacitly renewed for one-month periods, except where terminated under the conditions below.
4.2 Yearly subscription
The subscription is concluded for a one-year term, tacitly renewed for one-year periods, except where terminated under the conditions below.
4.3 Renewal information
In accordance with Article L. 215-1 of the French Consumer Code, the consumer User is informed by email, at the earliest three months and at the latest one month before the deadline allowing rejection of renewal, of the option not to renew their subscription.
5. Payment
5.1 Payment processor
Payments and billing are handled by Lemon Squeezy (Lemon Squeezy LLC, United States), acting as Merchant of Record for Viewroom Pro subscriptions. Lemon Squeezy is PCI-DSS certified, collects and remits VAT on behalf of the Publisher, and issues the commercial invoice in the User's name. Banking data never transit through Viewroom's servers and are not stored by the Publisher.
5.2 Terms
- The subscription is charged on the day of subscription, and then at each renewal date.
- In the event of a payment failure, the User has 7 days to remedy the situation. Failing this, the account switches to read-only.
- A PDF invoice is made available in the personal account area, in accordance with French invoicing legislation.
5.3 Electronic invoicing
The Publisher complies with the French electronic invoicing reform within the applicable regulatory deadlines.
6. Right of withdrawal
6.1 Consumer User (B2C)
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the consumer User has a 14-day withdrawal period from the date of subscription, without having to justify reasons or pay penalties.
Exception — immediate performance: as the service is a digital service supplied immediately, the User may expressly waive their right of withdrawal in order to access the Service without delay (Article L. 221-28 13° of the French Consumer Code). This waiver is collected in a clear and unambiguous manner upon subscription. In this case, the right of withdrawal can no longer be exercised once performance has begun.
In practice, since the 14-day free trial allows testing the entire Service before any payment, post-payment withdrawal remains rare — but the right is guaranteed for consumer Users who would not have wished to use the trial.
To exercise their right of withdrawal, the User notifies their decision to contact@viewroom.art with an unambiguous declaration. A standard withdrawal form is available on request.
6.2 Professional User (B2B)
The right of withdrawal does not apply to contracts concluded between professionals, in accordance with applicable law.
7. Termination
7.1 By the User
The User may terminate their subscription at any time from their personal account area, with no charge and no penalty.
- Monthly subscription: termination takes effect at the end of the current month. No refund of the period started.
- Yearly subscription: termination ends renewal. Access to the Service is maintained until the end of the paid period. No prorata refund of the year started — except in cases provided for by law.
7.2 By the Publisher
The Publisher may terminate the subscription in the event of a serious breach of the ToS or the ToSale, after a formal notice that has remained without effect for 15 days. In the event of flagrant illegality, termination may be immediate.
7.3 Effects of termination
Upon termination, the account switches to read-only to allow export. Data is then deleted in accordance with the Privacy Policy.
8. Warranties and liability
8.1 Legal warranty
The Publisher is bound by the legal warranties of conformity and hidden defects under the conditions provided for by the French Consumer Code and Civil Code.
8.2 Limits
The Publisher does not guarantee that the Service will be free from errors or interruptions. Its liability cannot be engaged for:
- indirect damages (loss of opportunity, commercial damage, damage to reputation);
- data losses due to a failure of the User to back up outside the Service;
- cases of force majeure or third-party action (cyber-attack despite reasonable security measures, hosting or payment provider outage).
In any event, the Publisher's liability towards a User is limited, all causes combined, to the amounts effectively paid by that User in the 12 months preceding the triggering event. This limitation does not apply in cases of gross negligence, intentional fault, or bodily harm, in accordance with the law.
9. Ownership of works
It is expressly recalled that the works uploaded by the User remain their exclusive property — see ToS §4. No provision of these ToSale shall be interpreted as a transfer, commercial licence, or assignment of rights over the works to the benefit of the Publisher.
10. Personal data
The processing of personal data is governed by the Privacy Policy.
11. Changes to the ToSale
These ToSale may be modified. Substantial modifications are notified by email at least 30 days before entry into force. They apply only at subscription renewal. A User who refuses the new ToSale may terminate at no cost with immediate effect.
12. Governing law and dispute resolution
These ToSale are governed by French law.
12.1 Amicable resolution
In the event of a dispute, the User is invited to contact the Publisher first at contact@viewroom.art, in order to seek an amicable solution.
12.2 Consumer mediation
In accordance with Articles L. 611-1 et seq. of the French Consumer Code, the consumer User may freely use a consumer mediation service. The competent mediator for Viewroom is being designated; their contact details will be published in this section once finalised. They may also access the European online dispute resolution platform: ec.europa.eu/consumers/odr.
12.3 Competent jurisdiction
Failing amicable resolution, the French courts shall have sole jurisdiction. For disputes between two professionals, the competent court shall be that of the Publisher's registered office, except where otherwise provided by law.
