Terms of Service

These Terms of Service (hereinafter "ToS") govern access to and use of the Viewroom service, available at viewroom.art. They apply to all users, free and paying. Accessing the Service implies full and complete acceptance of these ToS.

The conditions specific to paid subscriptions are set out in the Terms of Sale (ToSale).


What Viewroom commits to never doing

  • Never claim any rights over your works.
  • Never use your works for commercial, advertising, or promotional purposes without your explicit consent.
  • Never submit your works to artificial intelligence tools, model-training datasets, or automated analysis services operated by third parties.
  • Never resell, transfer, or license your contact list or your personal data.

These commitments are not marketing claims: they are legally binding under these ToS and the Privacy Policy.


1. Definitions

  • Service: the Viewroom platform and all its features (catalogue, artist portal, press kit, PDF export, link sharing, contact archive).
  • Publisher: the natural or legal person identified in the Legal Notice.
  • User: any person holding a Viewroom account, whether active or in trial.
  • User Content: the works, images, texts, documents, metadata, and information uploaded by the User to the Service.

2. Access to the Service

2.1 Account creation

Access to the Service requires creating an account. The User undertakes to:

  • provide accurate and up-to-date information;
  • keep their credentials confidential;
  • promptly report any unauthorized use of their account.

The User is solely responsible for activity carried out under their account.

2.2 Free trial

A 14-day free trial is offered upon account creation, with no credit card and no commitment. At the end of the trial, access to the Service is suspended if no subscription is taken out — data and works are retained so that the User may resubscribe at a later date.

2.3 Pro subscription

Pricing, payment, term, and termination conditions are governed by the Terms of Sale.


3. Use of the Service

The User undertakes to use the Service in compliance with the law, public order, and these ToS. In particular, it is forbidden to:

  • publish Content for which the User does not hold the rights;
  • publish counterfeit, defamatory, insulting, discriminatory, violent, pornographic, child-exploitation, hate-speech, or otherwise unlawful content;
  • attempt to access accounts, data, or parts of the Service that do not belong to them;
  • automate use of the Service outside of the officially provided interfaces (API, export);
  • resell, sublicense, or make the Service available to third parties for commercial purposes, without prior written agreement.

Any breach may result in suspension and then termination of the account, without prejudice to any legal proceedings.


4. User Content

4.1 Ownership

User Content remains the exclusive property of its author. Viewroom claims no intellectual property rights over the works, texts, images, and documents uploaded by Users.

4.2 Hosting licence

The User grants the Publisher a licence strictly limited to the technical needs of the Service: storing the Content, reproducing it on the servers, displaying it in the User's interface, and making it accessible to the people the User chooses to share it with (via public links, PDF, press kit).

This licence:

  • is non-exclusive (the User retains all their rights);
  • is free of charge;
  • is valid only for the time the Content remains on the Service — it terminates automatically when the Content or the account is deleted;
  • does not authorize any commercial, advertising, or promotional exploitation of the Content by the Publisher.

4.3 No AI training on works

The Publisher may use AI tooling for internal technical tasks (for example: assistance with filename parsing, metadata suggestions based on items already entered by the User). The Publisher expressly undertakes to never use User Content to train an AI model, internal or external.

Any future evolution of the Service introducing an AI feature applied directly to works will be explicit opt-in, documented, and limited to Users who have actively consented.

4.4 Liability

The User is solely responsible for the Content they publish. They warrant that they hold all necessary rights (copyright, image rights of persons depicted, third-party rights) and indemnify the Publisher against any third-party claim related to the Content published.

4.5 Moderation

The Publisher reserves the right to remove any Content that is manifestly unlawful and reported, in accordance with its hosting obligations under Article 6 of the French LCEN (Law no. 2004-575). No editorial moderation is carried out on Users' artistic work.


5. Availability and maintenance

The Publisher uses all reasonable means to ensure continuous access to the Service. Interruptions for maintenance, updates, or technical reasons may nonetheless occur. Where possible, planned maintenance is announced by email.

No service-level agreement (SLA) is guaranteed for the standard subscription. Major incidents are the subject of transparent email communication and, where appropriate, a goodwill gesture.


6. Intellectual property of the Service

The Service itself (code, design, visual identity, interface, documentation) is the exclusive property of the Publisher. No provision of these ToS transfers these rights to the User.


7. Personal data

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these ToS.


8. Termination

8.1 By the User

The User may delete their account at any time from the Service interface. Deletion ends the hosting licence and removes the User Content within the timeframes set out in the Privacy Policy.

8.2 By the Publisher

The Publisher may suspend or terminate an account in the event of a serious breach of these ToS, after a formal notice that has remained without effect for 15 days (except in cases of obvious urgency or flagrant illegality).

8.3 Export

In all circumstances, the User may export their entire catalogue (images + metadata) before account closure.


9. Liability

The Publisher uses reasonable means to provide a reliable Service. It cannot, however, be held liable for:

  • indirect damages (loss of opportunity, commercial damage, loss of reputation);
  • losses arising from non-compliant use of the Service;
  • losses arising from force majeure or third-party action (hosting provider outage, cyber-attack despite security measures).

The User is encouraged to keep their own copy of their works outside Viewroom — the Service is a tool, not a single safe.


10. Changes to the ToS

These ToS may be modified. Any substantial change is subject to email notification at least 30 days before its entry into force. Continued use of the Service after the effective date constitutes acceptance of the new ToS. Failing acceptance, the User may terminate their account at no cost.


11. Governing law and competent jurisdiction

These ToS are governed by French law. Any dispute relating to their interpretation or performance shall, failing an amicable agreement, fall under the jurisdiction of the competent French courts.

In accordance with Article L. 612-1 of the French Consumer Code, in the event of a dispute with a consumer, the consumer may freely use a consumer mediation service. The competent mediator is being designated; their contact details will be published in this section once finalised. In the meantime, the consumer User may contact contact@viewroom.art or access the European online dispute resolution platform: ec.europa.eu/consumers/odr.
